Decision of 4 December 2025 in case No. 176/2583/25

The claimant filed a lawsuit seeking UAH 245,000 in compensation for moral damages caused by health impairment due to an occupational disease (without deductions for personal income tax or other mandatory payments).

The claim states that the claimant worked for a long period—from 2 July 1985 to 28 January 2000—in various positions at the State Enterprise “Eastern Mining and Processing Plant,” including nearly 13 years at the Inhulska mine as a tunneler-blaster. During employment, he developed a chronic occupational disease. A medical and social expert commission (MSEC) established a permanent 60% loss of working capacity and assigned him a third-degree disability.

According to the investigation report, the disease developed due to prolonged underground work involving heavy physical labor, exposure to vibration, forced working postures, and an unfavorable microclimate. The causes of the occupational disease included physical overload, vibration, constrained posture, and hypothermia.

The court ruled:

• To partially satisfy the claim.
• To award UAH 200,000 in moral damages without deductions for taxes or mandatory payments.
