Decision of 5 December 2025 in case No. 176/1509/25

The claimant filed a lawsuit against the State Enterprise “Eastern Mining and Processing Plant,” seeking UAH 245,000 in compensation for moral damages caused by loss of working capacity due to an occupational disease (without deductions for personal income tax).

The claim states that the claimant worked at the State Enterprise “Eastern Mining and Processing Plant” in various positions, including under hazardous working conditions, and was dismissed on 29 April 2014. During his employment, he developed a chronic occupational disease, which later resulted in a third-degree disability and a 60% loss of working capacity. The claimant argued that the illness caused significant moral suffering, including disruption of normal life, inability to maintain usual activities, prolonged treatment, and constant physical pain and anxiety.

An investigation report dated 4 March 2015 established that the occupational disease resulted from long-term work under hazardous conditions inherent to the technological processes at the Smolinska mine.

The court ruled:

• To partially satisfy the claim.
• To award UAH 200,000 in moral damages without deductions for taxes or mandatory payments.
